An Ordinance to Establish Alcohol-Related License Fees for the Town of Stockholm

SECTION I – TITLE AND PURPOSE

This ordinance is entitled the Town of Stockholm Alcohol-Related License Fee Ordinance. The purpose of this ordinance is to establish a schedule of the fees for all types of alcohol-related licenses issued by the town.

SECTION II – AUTHORITY

The Town Board of the Town of Stockholm,  Pepin County, Wisconsin, has the specific authority under those specific sections of ch. 125, Wis. stats., stated next to the name of the license listed in the Schedule of Fees for Alcohol-Related Licenses set forth below to establish fees for alcohol-related licenses issued by the town.

SECTION III – ADOPTION OF ORDINANCE

This ordinance, adopted by a majority of the town board on a roll call vote with a quorum present and voting and proper notice having been given, adopts the Schedule of Fees for Alcohol-Related Licenses set forth below and establishes the fees for alcohol-related licenses issued by the town as stated therein.

SECTION IV – SCHEDULE OF FEES

Class “A” (Beer) sec. 125.25(4), Wis. Stats. Initial and renewal fee: $200

“Class A” (Liquor) sec. 125.51(2), Wis. Stats. Initial and renewal fee: $500

“Class A” (Cider Only) sec. 125.51(2)(e), Wis. Stats. Note: A retailer must possess a Class “A” (Beer) license to obtain a “Class A” (Cider Only) license. • No initial or renewal fee.

Class “B” License (Beer): sec. 125.26(4), Wis. Stats. Initial and renewal fee: $100

Temporary Class “B” License (Beer only Picnic License) for bona fide clubs etc: sec. 125.26(6), Wis. Stats. Fee for each: $10

“Class B” (Liquor) License information: According to the calculations set forth in sec. 125.51(4)(br), the Town of Stockholm does not have any Quota licenses. Note that according to sec. 125.51(3)(f) Wis. Stats, a “Class B” license may be issued only to a holder of a retail Class “B” license to sell fermented malt beverages unless the “Class B” license is a temporary “Class B” license under sub. (10).

Reserve “Class B” (Liquor) License: secs. 125.51(3)(e) Wis. Stats. Initial issuance fee $10,200, renewal fee for Reserve “Class B” License: $200

Above Quota “Class B” license for a “qualifying event venue” sec.125.24(5) Wis. Stats.
$200

Reserve “Class B” (Liquor) License for bona fide clubs and lodges situated and incorporated in the state for at least 6 years: sec. 125.51(3)(e)(2) Wis. Stats. $100

Temporary “Class B” License (“Class B” Picnic License) for bona fide clubs, churches, fairs, veteran posts etc: sec. 125.51(10), Wis. Stats. Fee for each: $10 Note: If a temporary Class “B” fermented malt beverage license and a temporary “Class B” wine license are issued for the same event, then only one fee may be imposed.

“Class C” (Wine Only): sec. 125.51(3m), Wis. Stats. $100

Operators’ (Bartenders’) Licenses: sec. 125.17, Wis. Stats. $10

SECTION V – SEVERABILITY

If any provision of this ordinance or its application to any person or circumstance is held invalid, the invalidity does not affect other provisions or applications of this ordinance that can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable.

SECTION VI – EFFECTIVE DATE

This ordinance is effective on publication or posting.

The town clerk shall properly post or publish this ordinance as required under s. 60.80, Wis. stats.

*Note: Class “A”, Class “B” and “Class A”, “Class B”, and “Class C” premise licenses issued for less than a year must be prorated for remaining portion of year. See ss. 125.25 (4)125.26 (4), and 125.51 (9), Wis. stats.
